These conditions govern use of the website. Accessing a page, reading its content, or submitting a search means that you accept every term below. If you disagree with any condition, stop using the site.

NO FCRA USE. Upshur County Criminal History is privately operated and has no connection with any government body. This site and its advertising partners do not provide a service intended for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act (FCRA). The site is a reference to criminal-record resources in Upshur County, West Virginia. It is neither a private investigation business nor a consumer reporting agency.

1. What This Website Is

This is a private reference site, independent of all government offices. We neither store official criminal records nor retrieve records, perform official checks, or submit documents for a user.

The material identifies the Upshur County Sheriff's Office, local courts, West Virginia State Police Criminal Identification Bureau, West Virginia State Police Sex Offender Registry, and other custodians that keep relevant records. Government access is subject to rules such as the West Virginia Freedom of Information Act, W. Va. Code §29B-1-1 et seq., and criminal-history dissemination is separately controlled by W. Va. Code §15-2-24.

2. Rules for Using This Site

As a condition of access, you must not:

West Virginia registry data is published under W. Va. Code §15-12-5a for public-safety purposes, and failure-to-register offenses are addressed in §15-12-8. Public access to the West Virginia State Police Sex Offender Registry does not authorize vigilantism, blacklisting, housing discrimination, or abuse of a listed person.

4. We Are Not a Consumer Reporting Agency

We are not a consumer reporting agency under the FCRA and do not create consumer reports, credit reports, or background checks. Our advertising partners and this site do not offer tools designed to assess applicants, renters, insurance risk, or creditworthiness. You may not use information from the site or a linked tool to:

  • Make any other decision regulated by the FCRA
  • Determine eligibility for a license, permit, or public program
  • Set insurance terms or assess creditworthiness
  • Evaluate a prospective renter or housing applicant
  • Make a hiring or termination decision

A check needed for a regulated purpose must come through an authorized, FCRA-compliant provider or the official process required by the West Virginia State Police.

5. No Legal Advice

Site content is not legal advice. General information about Upshur County records cannot determine how a conviction, charge, warrant, or expungement law affects an individual matter. Consult a lawyer licensed in West Virginia for legal advice.
